Citizens of the European Union in Spain – Entry and Exit
This section contains the conditions for the exercise of rights of entry and exit, free movement, stay, residence, permanent residence and work in Spain by citizens of other Member States of the European Union (Germany, Austria , Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Slovak Republic, Romania and Sweden), of the remaining States party to the Agreement on the European Economic Area (Norway, Iceland and Liechtenstein) and of the nationals of the Swiss Confederation, as well as the limitations to the above rights for reasons of public order, public security or public health.
Input and output
The entry into Spanish territory of the citizen of the Union will be carried out with the passport or identity document valid and in force and in which the nationality of the holder is recorded.
Family members who do not have the nationality of one of the Member States of the European Union or of another State party to the Agreement on the European Economic Area will enter with a valid and in force passport, also needing the corresponding entry visa. The issuance of these visas will be free and their processing will be preferential when they accompany or meet with the citizen of the European Union.
Possession of a valid and current residence card for a family member of a Union citizen, issued by another State party to the Agreement on the European Economic Area, will exempt said family members from the obligation to obtain an entry visa. and, upon presentation of said card, the stamping of the entry or exit stamp in the passport will not be required.
Any resolution refusing a visa or entry application must be justified. Said refusal resolution shall indicate the reasons on which it is based, either for not duly accrediting the required requirements, or for reasons of public order, safety or public health. The reasons will be made known to the interested party unless this is contrary to the security of the State.
In the cases in which a citizen of a Member State of the European Union or of a State party to the Agreement on the European Economic Area, or a member of his family, does not have the necessary travel documents to enter the territory Spanish, or, where appropriate, the visa, the Authorities responsible for border control will give these people, before proceeding to their return, the maximum facilities so that they can obtain or receive the necessary documents within a reasonable period of time, or to can confirm or prove by other means that they are beneficiaries of the scope of application of Royal Decree 240/2007, of February 16, on entry, free movement and residence in Spain of citizens of the Member States of the European Union and other States parties in the Agreement on the European Economic Area, provided that the absence of the travel document is the only reason that prevents entry into Spanish territory.
Citizens of a Member State of the European Union or of another State party to the Agreement on the European Economic Area, and members of their family regardless of their nationality, will have the right to leave Spain to move to another Member State, this regardless of the presentation of the valid passport or identity document to the border control officials if the exit is made through an authorized post, for its mandatory verification, and of the legal cases of prohibition of exit for reasons of national security or public health, or provided for in the Penal Code.
